2. SCOPE OF SERVICES
- Artist shall provide all musical equipment, amplifiers, microphone and all other equipment necessary for performance and services listed below:
- Artist shall provide services for the entire duration of the event specified in Section 2a.
- Artist is entitled to one meal provided by the Client, which must be equivalent to what is served to guests. Meals are required for all team members, which consist of 10 individuals (8 band members and 2 sound technicians).
- The 8-piece reception band performance is scheduled for a 3-hour block, which includes 2.5 hours of live music and one 30 minute break. The timing of the break will be at the Artist's discretion. During this break, the Artist will provide DJ services to maintain continuous entertainment.
- First dance and special dances (e.g., parent dances) are DJ'd and not included in the live band performance. If the Client would like the band to perform one or more of these special dances live, Artist may accommodate the request for an additional charge.
3. CLIENT REQUIREMENTS
- Client shall ensure the availability of sufficient power for the performance. The Artist's equipment requires standard 3-prong grounded outlets and does not exceed the power demands of typical outlets. For optimal performance and to minimize the risk of overloading circuits, the artist recommends the provision of two separate circuits, each equipped with grounded outlets, located within 25 feet of the performance area.
- Client shall provide a performance area measuring 24' × 15', with 3' of clearance on each side for speaker placement, totaling a 27' × 18' footprint. Additionally, there must be a minimum of 33 inches of clearance in front of the performance area for subwoofer placement. A stage is not required, as the performance area can be on the floor or on a stage. Please note, we do not provide stages; stages may be supplied by the venue or rented from a third party if desired. These space requirements are intended to ensure optimal sound quality and performance setup. If these dimensions cannot be fully accommodated, please let us know in advance. We're happy to work with you and adjust as needed.
- If the performance is outdoors, the Client must provide adequate coverage for the stage area, such as a deep, dry overhang or a tent with sides, to protect the Artist and equipment from inclement weather. Additionally, the staging area must be dry, level, and stable. Performances cannot take place on wet grass, mud, uneven ground, or any other surface that poses a risk to equipment or performer safety (e.g., unstable tripods or speaker stands). The Client will be liable for any equipment damage caused by the lack of proper cover or an unsuitable staging surface.
4. PAYMENT TERMS
- Client agrees to pay the Artist a fixed fee of — for services provided under Section 2a.

- A total cost of —, which includes the performance fee (Section 4a) and travel expenses (Section 4b), is due in full one day prior to the event.

- In the event of cancellation, the deposit is fully refundable, except for $100, which will be retained as a non-refundable retainer fee to reserve the performance date.
- Once the performance takes place, the fee is non-refundable.
6. CLIENT PORTAL
The Client Portal is an online planning platform provided by the Artist to the Client upon contract execution. It includes the Song Selector, Day-of Checklist, and Ceremony Planner — tools used to collect live music preferences and key wedding day details.
- Client will complete all applicable sections of the Client Portal to the best of their ability.
- The Client Portal is to be completed no later than one month prior to the wedding date. If more time is needed, Client will notify the Artist.
- Client will provide playlists for key moments (e.g., dinner music, wedding party entrance, etc.) via the Client Portal. Artist prefers Spotify playlists but can accommodate other formats if needed.
- Artist reserves the right to charge additional fees based on logistical or technical information submitted through the Client Portal. For example, if the ceremony takes place in a separate room or at a significant distance from the reception, requiring major equipment relocation, additional staffing, or expanded setup, extra charges may apply.
7. SONG REQUESTS
- Artist will make best effort to perform songs marked as Priority in the Client Portal Song Selector.
- All songs selected for live performance are for consideration by the Artist, but are not guaranteed unless designated as Priority requests, subject to the limits stated in the Client Portal.
- Artist will not take song requests during live performance.
- Artist will not play or perform songs marked 'Do Not Play' in the Client Portal Song Selector.
- Client may request songs to be played via Spotify or other pre-recorded formats at any time before or during moments when pre-recorded music is played.
9. PERSONAL SERVICE GUARANTEE
- Artist will serve as your exclusive event entertainer. In the unlikely event of circumstances beyond our control (hospitalization, accident, etc), Artist will make every effort to find a replacement for your event.
10. ACCESS AND SETUP
- The Artist is not responsible for delays due to misdirection.
- The Client is responsible for providing the Artist with access to the event site for setup, as well as notifying the Artist of any changes in time or location.
- The Artist requires at least 2 hours before the event start time for soundcheck and setup.
- The Artist requires at least 1 hour after the event for breakdown and loadout.
11. ATTENDANCE
- Artist attendance is guaranteed in compliance with the terms of this contract. In the highly unlikely event of a 'no-show' to a regularly booked, scheduled, and fully paid-for event, Artist will refund the balance, in full, to the Contract Executor/Signee.
13. LEGAL AND LIABILITY
- Client is responsible for all legal fees in the event of court action.
14. ACTS OF GOD
- The Artist is not responsible for events outside our control, such as law enforcement intervention, power outages, weather, or guest actions, that cause the early cessation of the event.
- In the event of extreme weather or an "Act of God" requiring evacuation, the Artist will attempt to reschedule once the evacuation is lifted. The balance paid will serve as a retainer for the new date, with one year to redeem the credit. If not redeemed within the year, the Artist will keep the payment.
15. CLIENT INDEMNIFICATION AND RELEASE OF LIABILITY
- I, Client, acknowledge that my contract with the Artist is voluntary. I understand that dancing is a risky activity that could result in injury or death. In consideration of the Artist's services, I agree to indemnify and hold harmless the Artist, its agents, employees, and contractors from any claims, losses, damages, or expenses, including attorney fees, arising from personal injury, death, or property damage related to my participation in this activity, even if caused by the negligence of the Artist or its representatives.
16. ASSIGNABILITY
- The Artist's services are personal and cannot be assigned, sublet, or transferred without the Client's prior written approval.
17. ARTIST AS INDEPENDENT CONTRACTOR
- The Artist shall perform all work under this Agreement as an independent contractor and not as an agent or an employee of the Client.
18. ENTIRE AGREEMENT
- This agreement represents the entire understanding between the parties, superseding all prior oral or written agreements on the subject.
19. MODIFICATION
- No changes to this Agreement are valid unless made in writing, signed by both parties, and approved by the Client.
20. WAIVER
- No failure to enforce any part of this Agreement shall be seen as a waiver of the right to enforce it later. Accepting payment or performance after a default does not waive any rights or imply acceptance of defective performance.
21. GOVERNING LAW
- This agreement is governed by Ohio law. Disputes will be settled in Franklin County courts.
23. AGREEMENT
By my signature on the original contract, I acknowledge receipt and acceptance of the terms and conditions of this agreement as outlined.
